Terms of use

These terms govern your use of this website and of software published by Solace Foundry Ltd. (“we”, “us”), a limited liability company formed in Colorado, United States. By using our software or this site, you agree to them.

1. Who may use our software

You must be at least 17 years old. You are responsible for keeping your account credentials secure and for activity that happens under your account.

2. What Serein is, and what it is not

Serein is a self-imposed commitment and accountability tool. It is not a medical device, and not a treatment for any condition, and it is not a substitute for professional medical, psychological, or therapeutic care. We make no claim that using it will produce any particular outcome. If you are struggling, please also speak to a doctor or a qualified professional.

Serein restricts access using facilities the operating system provides. It is a deterrent, not a guarantee: no software can make something impossible to reach on a device you physically control. You accept that determined circumvention is possible and that we are not responsible for it.

3. The Witness relationship

Serein lets you nominate another person as your Witness. You are choosing to give that person a role in approving or refusing changes you request.

• You are responsible for choosing someone appropriate and for having their agreement to act.
• A Witness cannot alter your settings and does not receive a record of your activity. Their role is limited to responding to requests you make.
• You may remove or replace your Witness at any time, which ends their access immediately.
• We are not a party to, and not responsible for, what passes between you and the person you nominate.

4. Subscriptions and payment

Where our software offers a paid subscription, it is sold and billed by Apple through the App Store, under Apple’s terms. Subscriptions renew automatically until cancelled. You manage and cancel a subscription in the Settings app under your Apple Account, not with us. Refunds are handled by Apple. We are not able to charge, cancel, or refund an App Store subscription on your behalf.

5. Acceptable use

You agree not to:

• use our software to monitor, restrict, or coerce another person without their knowledge and consent;
• attempt to gain unauthorised access to our systems, other users’ accounts, or any data that is not yours;
• reverse engineer, resell, or redistribute our software except where the law gives you that right;
• use our software for anything unlawful.

The first of these matters most to us. Serein is built for people restricting their own access, with help they asked for. Using it against someone else is a misuse of the product and grounds for us ending your access.

6. Availability

We provide our software and this site on an “as is” basis. We work to keep things running but do not promise uninterrupted or error-free service, and we may change, suspend, or discontinue features. Where a change materially reduces what a paid subscription provides, we will tell you.

7. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, and to the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, or data, arising from your use of our software.

If you are a consumer, you have statutory rights that these terms do not affect.

8. Intellectual property

Our software, this website, and their content belong to us. Using them does not transfer any ownership. Content you write — your pledge, your notes — remains yours.

9. Ending your use

You may stop at any time by deleting your account and removing the app. We may suspend or end access where these terms are seriously or repeatedly breached.

10. Governing law

These terms are governed by the laws of the State of Colorado, United States, and disputes fall to the state or federal courts located in Colorado. If you are a consumer resident elsewhere, this does not deprive you of the protection of your local mandatory law.

11. Changes to these terms

We may update these terms. The date at the top of this page shows the current version, and we will notify you in-app of any significant change.
